What Is Expungement?

When the court grants your petition for expungement, the criminal record of your arrest and conviction are sealed. After your record is expunged, you can honestly answer "No" when someone asks if you have ever been arrested for or convicted of a crime.

There are several factors affecting expungement eligibility, including:

  • The type and severity of the crime involved
  • Whether or not you were ultimately acquitted
  • How many convictions are on your record

It is important to note, however, that you are only granted one opportunity to expunge your criminal record in New Jersey. Therefore, it is vital that you work to keep your record clean after expungement is granted.
